SOVASH Affiliate Program — Terms & Conditions

This Affiliate Program Agreement (the “Agreement”) is a legally binding contract between SOVASH LLC (“Company,” “we,” “us,” or “our”) and you, the individual or entity applying to participate in our affiliate program (the “Affiliate,” “you,” or “your”). By applying for and participating in the SOVASH Affiliate Program (the “Program”), you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.

1. Enrollment and Acceptance

  • To enroll, you must submit a complete and accurate application form.
  • We may approve, reject, or remove any application at our sole discretion and without providing a reason.
  • Applications may be rejected or terminated if your platform:
    • Promotes sexually explicit content, violence, illegal activities, or discrimination;
    • Infringes or enables infringement of any intellectual property rights;
    • Is unlawful, defamatory, obscene, harassing, misleading, or otherwise objectionable in our judgment.

2. Affiliate Responsibilities & Conduct

  • FTC Compliance. Clearly disclose your affiliate relationship in all promotions. Acceptable disclosures include “#ad,” “#sponsored,” or “As a SOVASH partner, I earn from qualifying purchases.”
  • Accurate Promotion. Represent SOVASH products truthfully. False, misleading, or unsubstantiated claims are prohibited.
  • Brand Protection. Do not impersonate SOVASH or create channels likely to be confused with official SOVASH accounts.
  • Professional Conduct. Act in good faith and consistently with our brand values.

3. Prohibited Promotional Methods

Violations may result in immediate termination and forfeiture of unpaid commissions.

  • PPC Advertising: No bidding on “SOVASH” (or variations/misspellings) in search ads.
  • Coupon Abuse: Do not post your code on coupon/deal/aggregator sites. Codes are for your direct audience only.
  • Spam: No unsolicited bulk emails, DMs, or comment spam.
  • Adware/Spyware/Bots: No parasitic software, redirects, or forced clicks.
  • Self-Purchases: You, your immediate family, or anyone acting on your behalf may not use your code.

4. Commissions & Payouts

  • Commission Rate: 15% of the final order value of Qualified Sales.
  • Qualified Sale: A sale where your assigned coupon code is correctly entered at checkout for an eligible product.
  • Product Eligibility: At this time, commissions apply only to the SOVASH Advanced Collagen Deep Hydration Mask. Eligibility may change at any time.
  • Verification Hold: All commissions are subject to a 30-day hold to account for returns, chargebacks, and fraud review.
  • Minimum Payout: Payments are issued when your verified balance reaches $50 USD; lower balances roll over.
  • Payout Schedule & Method: Monthly via bank transfer (Wise, Airwallex, or equivalent). You must maintain accurate payment details.
  • Chargebacks/Returns: Commissions tied to refunded or disputed orders are reversed, even if previously paid.
Retroactive Rule: Orders without the correct coupon code at checkout cannot be credited retroactively under any circumstances.
Code Ownership: Your code is exclusive to you and may not be shared, transferred, resold, or reassigned. Misuse may result in immediate removal and forfeiture of commissions.
Fraud Reserve: We may withhold or reverse commissions at any time for suspected fraud, abuse, or policy violations—even after a commission is marked “verified.”

Taxes: You are solely responsible for reporting and paying all applicable taxes.

5. Tracking and Qualified Sales

  • The Program uses coupon code tracking only. We do not provide affiliate links or cookie-based tracking.
  • Only sales where the assigned code is properly entered at checkout will qualify for commissions.
  • If a customer uses a different code, enters it incorrectly, or forgets to apply it, no commission will be credited.

6. Intellectual Property

We grant you a limited, non-exclusive, revocable license to use SOVASH brand assets (logos, product images, banners) provided in our creator toolkit solely to promote SOVASH under this Program. Assets may not be altered or used in a misleading manner.

7. Term & Termination

  • This Agreement begins upon approval of your application and continues until terminated by either party.
  • You may terminate at any time by written notice.
  • We may terminate (a) with 7 days’ notice at our discretion, or (b) immediately without notice for any breach, suspected fraud, or abuse.
  • Upon termination, remove all SOVASH materials from your channels. Unpaid commissions may be forfeited if termination results from fraud, abuse, or policy violations.

8. Relationship of Parties

You are an independent contractor. Nothing here creates a partnership, joint venture, agency, franchise, or employment relationship. You may not act or speak on behalf of SOVASH.

9. Disclaimers & Liability

  • No Earnings Guarantee: Results vary by audience, content, and effort.
  • Limitation of Liability: We are not liable for indirect, incidental, special, or consequential damages (including loss of revenue, profits, or data) arising from this Agreement or the Program.

10. Modification

We may modify these Terms at any time at our sole discretion. Notice will be provided via email or the affiliate dashboard. Continued participation after notice constitutes acceptance of the updated Terms.

11. Governing Law

This Agreement is governed by and construed under the laws of the State of Wyoming, USA, without regard to conflict of law rules.
